Terrible Dealer Service... Need advises

Here goes the Story: My dad had a 96 3000GT bought brand new with the so called "platinum extention warranty".
Over the last 7 years, we had went through 2 transmission and (Maybe 2 transfer case too, I'm not sure on that.) However, there's never a complaint filed from my dad. It's just that he brought in the car for normal maintenance and they told my dad he needs a new tranny, get ther rental for my dad and sent him home. We were awear of the weird actions, but since it's under the warranty, we don't need to pay anything so we let them do whatever "that needs to be done."

Last service (which is closed to the extended warranty expires), they put a 3rd Transmission on it, reason is they find it leaking tran fluid. Then here is the problem, as soon as my dad got the car, he couldn't shift it into gears in cold. We had called back to the dealership and notify them the problem, they told us the Warranty company chose one aftermarket tranny rebuild company and send them this transmission and "it's intented to be tight."

Last month, I had been dropping off the car to the dealership more than 3 times, everytime, they said they had found no problem, it's notchy in cold, but it's normal. Me and my dad had been driven the same car for that many years, and we never had the problem, the problem is being so severe that sometime in the morning, it would actually grind before the gear gets in. I was questioning about the shift linkage not being align right, they went ahead and changed the shifter bushing... That helps, but when the car is cold, it really couldn't get into 2nd and 3rd, unless being extremely forceful and "bang" the shifter into the gears...
I had the Tech rode along with me, and he saw the problem.

Now 4 days later, he called my dad and said they had several people driven it, and they didn't find the problem. They will not do anything about it.

I suspected the Extended warranty company will not reward the fix since the car is over the warranty period, in other words, we are screwed... but on the other side, the dealership just kept saying the Transmission company would have 12 months, 10000 miles warranty. But they have to deny it since they couldn't find the problem.

My question is that if someone wanted to hide the problem, even the problem is there, they can still say "I can't feel it, it's completely ok"

I'm so so upset right now, and I don't know what I can do. I'm so worried because this problem sometime would make the car extremely dangerous to drive. My dad almost got rear-ended couple days ago at the on ramp just because he couldn't get into second and third...

Please anyone can give me the advise??
 
If that's a clutch problem, how could it only happen after they "fix" my car with the new transmission??

So you are saying that I should just shift it without the engine on in cold morning ?? (as a way to pin point the problem?)

I pretty much eliminated it's being the clutch problem because there's no problem shifting to 4th, 5th and 6th... and also, the car is perfectly fine after warming up... (not just engine warm up, I mean like after I drove it for 15 mins on highway, when I get off the highway and back to the city driving, the shifting is fine.)

Just wondering, but what about the possibility of getting a trusted independent mechanic to look at it, and document the problem (if any), then providing the results to the dealer? They would have a hard time hiding it at that point, I would think.
