145mph not dangerous driving - court



A driver caught by police doing 145mph on a motorway has escaped a ban after a court accepted that the speed did not represent dangerous driving.
Police recorded the speed of company director Ian Tyre's Honda NSX sports car on the M4 motorway at more than double the legal limit.

Cardiff Crown Court was told that the car, which is capable of 180mph, was going so fast that a patrol car could not keep up.

Prosecutor Caroline Rees told the court that Mr Tyre accelerated from 95mph to 145mph on a downhill stretch of road.

"At that point he pulled away," she explained. "The top speed of the police car was only 140mph."


Speed monitored

Police monitored the car's speed using an onboard computer.

Miss Rees said: "The officer kept his siren off to make sure he recorded an accurate reading of the speed.

"He was finally stopped on an A-road after pulling off the motorway three junctions on."

Mr Tyre, 43, of Bridgend, Mid Glamorgan, was charged with speeding and dangerous driving.

He chose to go to a crown court trial to contest the charge of dangerous driving.

Defence barrister Nicholas Jones said his client admitted driving at 95mph but said: "This was not dangerous driving.

"Even if Mr Tyre was driving at 140mph, that is not dangerous either.

"It is a case of a very experienced driver in a car in very good condition, not drunk and displaying no loss of control".

The jury took an hour to find Mr Tyre not guilty of dangerous driving.

He will appear before magistrates at a later date to face a charge of speeding.
 
LOL... thats great... but it would never wash in the states. He'd be behind bars right now after being on "america's greatest police chases".
 
Not to mention that in the US, they did away with jury trials for traffic infractions. I would venture to say that the juries would find the majority of people "not guilty' if jury trials were allowed.
 
Actually, I read an article not too long ago, about a kid on a bike who got caught doing 135 mph, and the municipal judge (Billings, MT) ruled that speed in and of itself was not wreckless. The wreckless driving charge was dismissed and the speeding charge stuck.

lol, I did 160 last month on my way from LA to Seattle, in Portland Oregon. The moment I passed the border to Washington, I got a ticket for going 86.

AKA...He lost his license and had to pay a hefty fine...Trust me i know from Experience:frown:
 
I agree, speeding would stick for the mph but reckless driving must be proven thru his actions that would deem it reckless and dangerous to people on the road. There is no fine line in Texas that says that a certain mph over the posted limit is reckless or dangerous but must be proven to a reasonable person (Jury or Judge) that his actions were reckless and dangerous. Speeding on the other hand is very easy to prove. If he had a supercharger, I am sure 180 is not that difficult.:tongue:

It was not a good thing that this was not wreckless.

I was pulled over years ago in a 72 pantera I use to own doing 145.This was in Seattle on the 405.The cop coudnt proove how fast I was going.So he wrote me up for 90.He said he was going 120 for a long time trying to catch up.My lucky day.
 
Almost any publicity for the NSX is good publicity. The police cruiser couldn't keep up. :biggrin: :biggrin: :biggrin:
