buying from private party..

hey guys! when you purchased your car from private party (meaning car being paid in cash, not financing), and got it registered under your name, did you have to pay any additional tax other than regular registration fees?
for the bill of sale price, what do most of you guys put down? just to let you know, the transaction if being done in california.

yes, you have to pay "use tax" in CA, which happens to be the same rate of sales tax (which I think is 8.25%) . You also have to smog it.

Now, if you want to state (under the penalty of perjury) that you purchased the vehicle at least 12 months ago and it has not entered the state of CA within that period of time: the use tax is waived. It is also waived during an intra-family transfer too.

It is a heavy duty felony if DMV can prove your story is not legit. (just ask Scooter Libby and President Clinton about perjury).

Lets see, Oregon doesn't have Use Tax....which means people that register their car in Oregon don't have to pay it.

Each state can adopt their own laws for this matter and obviously you have helped the poster with the specifics for CA. Sometimes the seller may be willing to "help you" by listing a lower sales amount on the bill of sale. In AZ you don't have to pay anything if it's purchased from a private party (either in-state or out-of-state), but you have to pay the state sales tax if it is purchased from a dealer outside of AZ. Sometimes the local municipality will also send you a letter to collect their portion of the sales tax locally, but I don't know how frequently this actually occurs.

It's definitely interesting to see the different laws of each state on things like this.

The tax rate varies by county.

In California, the seller is required to provide a current valid smog certificate. Lots of people don't know that's supposed to happen; last time I sold a car privately and gave the buyer a smog certificate, he was surprised that I had done it.
