Paypal - Am I SOL on a claim question?

Hello,

I'm hoping someone will be able to help me answer some of the questions based on their experience with Paypal.

Here's my situation: I made a payment to the seller outside of Ebay. 50% of the transaction was money sitting in my Paypal account. And the other 50% of the it came from my American Express charge.

I have sent numerous email requesting him to send my item that we both agreed upon. I"m a VERIFIED member in Paypal, and he's a PRIME VERIFIED member. I do know his ebay ID as well.

My questions:

Can I recover the money by complaining to Paypal?

If not, should I complaint to American Express even though the transaction was originated from Paypal to recover the 50%?

What kind of information should I provide to Paypal or American Express?

How soon can I complain to Paypal or American Express?

If he hasn't mailed you the item, if you haven't recieved anything, you can file a paypal dispute provided you paid him in the last 30 days - to do this go to the transaction in your paypal register, click on 'details', and at the bottom of the page there is a link for 'open a dispute' - as he has not been responding to you I would escalate it to an investigation right away, and paypal will look into the transaction for you.

If he has a tracking number that shows a package sent to you you are SOL, if he does not you will get a refund, but paypal is pretty good with buyer non-receipt, assuming the situation is exactly as you told it. If the item were not as described, broken, etc. paypal will not help you, but if you didn't get anything they will, and going via your credit card will only put your paypal account in bad standing.
