Guys, need some help. I was wondering whether anyone can tell me why someone would want to avoid litigation in a California court over real estate?

My guess is it's directly or indirectly related to the "Subprime Fiasco" post not far from this one. Otherwise, I have no clue what you are talking about because everyone would want to avoid litigation if possible.
 
I'm enrolled in this real estate law class (taking it for fun, now I'm thinking maybe I should get a refund! :tongue: ), and this is our 1st discussion question. No points are awarded per se, but class participation is worth 30%, so I really want to bring something to table and not be a silent by stander. I'm just like the rest of you, I'm totally lost! I went through some reading materials, but other than trying to figure out exactly what California is doing differently than the other states, I really don't know how to answer this!
 
Now that you gave us a little extra information, it seems pretty obvious there is a goofy law in California that causes more problems than compared to the rest of the U.S. How unusual..

Maybe the average case costs $55,000 more than other states, that is another route you could investigate.
