Hey Primers,
I'm currently looking for legal help related to a workers comp claim. Just to make my story short I hurt myself at work almost two years ago went to the hospital and filed a workers comp claim thru my employer. Few months after that incident I started receiving a bunch a hospital bills that my employers insurance should have took care of but never die. I was back and forth dealing my employer, they finally told me they would take care of everything but again they never did and now I found out I've reported to the credit bureau for collection and delinquency. I'm looking take to take legal actions but I really don't know where to start. If any of you guys have dealt with these type of cases or know somebody I would really appreciate some help.

The restaurants manager or hr should have handled it. You as a employee needed to keep all documentation of the event, hospital stays, bills, and prescriptions and given it to the correct person in the company. That person then forwards it to their insurance provider/claim person.

I'm dealing with a situation right now.

I've been in contact with them since I started receiving these bills, I was told everything was taking care of but I found out that they didn't do anything when I applied for CC and got denied so when I got my CC report I noticed I was reported for collection.

So the management never reported your claim to their workers compensation company?

Don't know what to say other then they are idiots.

Why has it taken 2 years for them to try and track you down? I had another previous claim that the employee went to the hospital, got stitches and returned to work. I kept missing the claims person playing phone tag and things but they were on the employee right away about the bills for the hospital.

Something's not adding up that it's been 2 years...

I don't think it was denied because I talked to the adjuster of my claim then I talked to my manager everything seems to be working fine but it didn't. They already affected my credit which was almost perfect so now I don't know what to do, so I'm looking for a legal way to proceed.

So it was approved, but just never paid? Sounds like a goof up. You need to fix 2 separate issues here. Get the debt cleared up with the insurance and whoever holds the claim to the debt. Then clear up your credit. You can dispute anything on your credit reports, and get it removed if they agree with you, but take your time and make sure you have a strong and cohesive story with credible proof. Get an affidavit from the insurance company if you can. Do some research.

I once found out about a claim on my credit history in the same way, after applying for a credit card. It was legit, but I never knew about it. I had been in an accident, and the ambulance co sent a bill to the address on my license, which was out of date. I found out over a year later. I called up the collection co, explained my story, and they offered to completely remove the claim if I paid the bill. Easypeasy.
