Sorry for your woes, HOA's drive me crazy, including my own. Most of the time they are a bunch of over zealous numb skulls who are happy to have any power and abuse whatever power they have. The stuff, I've seen and heard is ridiculous.

I hope that you can get legal justice with this guy, he sounds like a jack...as well as the tow truck company. Many tow truck companies are a bunch of low life predators!

I love the asshat idea! That's great. But it will be much more satisfaction when the process server pounds on his door and serves him. I wonder if he'll call the cops on him! When this happened my husband went down and pounded on his door - his only response was "call the cops!" He did, they came, but my husband had already left to meet me up north with my keys.

I'm also trying for the GTA angle - statute says, permanently OR temporarily deprives owner of their property. Having a detective knock on his door is also priceless.

This is NOT the tow company on call for the community. This tow company was out of another county, more than 40 miles away. I'm sure they googled and googled until they found one that 1) would even come there and do it, and 2) was the furthest away they could find. Everything THEY did was a violation of the tow laws. Since the violation didn't actually occur until they crossed the 15 mile radius and that happened in the next county north, their sheriff's office is handling that. They'll let me know what they do about it.

I love the manure idea, but you're right - I don't want to lower myself to their idiotic level and any potential retaliation. My attorney says, he'll do depos, run up everything and take it to trial - nothing else will suffice! His fee, he'll take whatever the court says so and FROM the defendant.
 
Since it is Halloween, I wonder if his house will get egged and trees strewn with toilet paper from those teenagers out trick-or-treating? :wink::wink:
 
Go to Barnes & Noble, pull a subscription postcard out of every magazine on the racks and have a friend fill each one out (so the handwriting can't be traced back to you) with the neighbor's name and address.

Posting his car for sale at a bargain basement price on Craigslist (via a proxy server of course) would also prove to be quite annoying for the nasty neighbor.

I have many other suggestions but these two should get you off to a good start.

Have the jerks car towed by the same tow company/guy that towed your nsx, if the jerk goes "coo coo for coco puffs" by all means...get it on video n post here :)

who knows...maybe you will have him towed several times hehehe...

My friend played a joke on me once and posted a free trampoline on Craigslist with my phone#. You would not believe how many people called. It was non-stop for hours.
 
Actually the magazine idea was given to me yesterday by a co-worker! I really like that one. There's just so many possibilities...
 
had this happened to me in california i would handle it via small claims where the limit is 10k and the parties may not have an attorney involved ... you could document the situation, including correspondence with the driveway owners out of country indicating they had not requested / given permission for the guy to have your car towed. he wouldn't be able to hide behind an atty in small claims :)

perhaps you can use your own small claims system to confront / bring this to resolution?

btw, i'm all for the subscription-thing ... i did that to my best friend when he was in med school ;) but please keep in mind that some activities / actions carry severe (state / federal misdemeanor / felony) penalties if you're discovered.

Sorry I haven't been around lately. I had to have some major surgery. But I'm getting back up now, won't be able to drive the NSX for quite some time now. Just can't get into to it right now. I did get an email from my attorney this morning. His process server has NOT been able to serve them yet. They won't answer the door. He's checked, the blinds are all closed (always are) and there are no cars in the driveway. That's because they can hit their garage door opener from a block away and get into the garage and close it all before even shutting off the car. So I gave them some places where they are supposed to be with all their friends and they're going to stake it out and wait for them. What a bunch of cowards! Take the medicine!

this lady in my parents neighborhood put up signs last year on holloween no candy, do not disturb, she put a barrier across her driveway

to stop little kids from going up and knocking on her door. then she wrote stay away on her SUV's rear window. S

he is an Mean old lady of the hood, calls the city if your trash can is not in the proper spot in the road etc. everyone knows this kind of person.

well this year she didnt put any of that stay away, no candy here etc crap cuz

she got 86.00 dollars worth of toilet paper, and 43 dollars worth of eggs to decorate her yard last halloween. so this year she only had her lights off thru out the house. people dont knock on your door if the light are all off. so she learned a lesson.

Well, Mrs. Duffass was finally served on Wednesday night. They'd been trying to serve her for weeks. We had left for dinner at around 6:10 and saw Mr. Duffass' car parked in his driveway. Very unusual for him as he's such a coward he's always got his garage door open before he comes around the corner and is in there and closes the door before he shuts off the car. WELL, apparently the process server saw this too as as soon as he left, he went up and served the Mrs.! She apparently called Mr. back immediately because one of my neighbors at the other end of the street said he'd come home to pick something up around 6:45 and saw Mr.'s car abruptly parked in his driveway, sideways! HA! Take that! The same neighbor told me that our landscaper called him (remember this is an HOA) and said that Mr. Duffass called him about what he recollected about that day - the landscaper had called my neighbor across the street when it was happening to tell her to call me. Mrs. has 20 business days to respond to my complaint - so just after Christmas. We shall see. Especially if she/he tries to find his own attorney here in town ----- as working for a particular branch of the government, I think I know most all the attorneys and NONE would represent them when I am the plaintiff! Well see now if he continues to glare at me when he passes me on the road anymore! I think I'll wave to him!
 
Good job sticking with it. Sometimes time passes and the pain is less felt so we lose drive for justice. Stick it to this creepy family!!!
 
You are a better person than I am. Because I would have lost it and gone straight out revenge on that clown.
