Ebay. Tax or No Tax? That is the question

This is sometinhg I always wondered about, and the thread about the guy selling his wheels for a dollar and charging $2300 shipping aroused my curiosity again.

If I buy used wheels, for example, from just a normal person like my next door neighbor off of Ebay, can he charge me tax? I had a transaction with a person for some widgit, and the seller charged me tax because he was in the state of California as well. Did not own a business or have a license to operate any sort of business to pay tax on. If you or I are just a person selling our junk, can we charge tax too without any sort of business? It just seems like a way to make extra money. How do you reply to joe regular that is adding tax on if he is just a regular person, and not a business?
 
If you are a business, you have to charge tax legally. If you are just selling personal items, or things for a friend...whatever, there is NO TAX.

Great little way to make extra cash, or in your case, spend a little extra....lol.

He is just making some more profit.
 
In state business have to charge tax per requirement form the State Board of Equalization.

Personal items were already taxed at purchase. Also they are not submitting the tax to the State Board. So if a person is charging tax.. He is illegally collecting tax.

Exception is car purchase.. DMV will tax you regardless of you buying a car from a dealer or a friend.
