The DMCA gives the US Copyright office authority to determine which technologies are exempt from the anti-circumvention provisions of the DMCA. According to yesterday's announcement by the Copyright office, it's still acceptable to jailbreak your phone, but not your tablet computer or game console. So for example you can install Cydia on your iphone but not your iPad or iPod, nor can you install ICS on your Kindle Fire or linux on your XBox. In the US, at least.
