Hi SNDSOUL,
I saw your reply on NSXPrime. Is the gauge cluster still available? Odometer
and speedo works, just the tach and speedo needle are missing, right? I need a
cluster to replace my broken odometer. Will you take $100 + S/H?
Ojas

Hi Brett,
I can do paypal. What's your paypal id, same as your email? Can you give me
the total (incl shipping to address below), then I will send you the funds via
paypal. Also, how many miles does the odometer show on it?
Thanks,

Ojas, our mail must be getting crossed somewhere. The only odometer I have is the one in my car. I did not get one when I bought the cluster from erzcars. If that is the part you need I'm sorry, but I dont have an extra odometer, must have been some miscommunication somewhere b/c I am sure I stated that in the second email I sent you. Sorry for any inconvience. --Brett

Brett,
I assume you were not able to locate an odometer.
I don't know what the problem is. You're partially correct. As my email log shows, on July 7, _I sent_ you an email with my shipping address and, out of curiosity, asked how many miles were on the odometer.
However, having not heard from you in almost two weeks after I sent that email (13 days to be exact), _I sent_ another email on July 20 asking if you still had the odometer. About 1 hour later I got your paypal funds request. I _never_ got an email from you between these two correspondances.
And without a doubt, I _never_ received any indication from you that odometer was not in the cluster!
I also never delete any of my email messages and have 3 years of emails / 5000+ messages filed away on my server. Since it's possible I may have skipped over an email or not read an email completely, I double checked... There is nothing there from you between these dates and nothing indicating that the odometer was missing. Perhaps you are thinking of someone else. Please, don't think I'm am being rude, but considering how many times you asked me for my address, I am left to conclude that any miscommunication has to be on your end.
Basically, as it stands right now, I have a part that is 100% useless to me. Also, from my point-of-view, I don't see how I could possibly be at fault. However, I do understand that stuff occasionally happens during these types of transactions.
Honestly, I think you should give me my full $110 back since you did not disclose the missing odometer to me. But hell, if the $10 shipping is such a big deal, I'll 1) eat the shipping to me and 2) paying for insured shipping back to you to get my $100 back. This way I am out $20 or so in shipping and you net zero dollar. I think this is a _more-than-reasonable_ resolution to the matter.
Please let know how you'd like to proceed.

Brett, I sent you the following message last weekend and have not heard from you. Again, I think the resolution I proposed is VERY reasonable. Can you agree to refunding me the original amount of $100, with me covering the shipping you paid to me ($10) plus shipping back to you. I need a reply by Friday (9/13/2002) NOON CST at the latest.

Ojas, I have located an odometer through a body shop. They are asking $100 for it. I am willing to pay half($50.00) due to our misunderstanding. I am not willing to take the cluster back, you bought it and it is now yours. By paying half for the odometer though, I am essentially giving you $50.00 back for the miscommunication. Work with me here and we can settle this gracefully.--

I appreciate the prompt reply. But are you serious????
In your previous email, I understood your objection to the refund was that you'd have lost the $10 shipping. In response I presented an offer refunding your shipping.
NOW, you seem to have rejected that offer (unwilling to refund me $100). And now you're tell me you've spent the time and effort to locate an odometer and are willing pay $50 out of "generiousity"?
The way I see it, you're still at fault because you never disclosed the missing odometer. At one point you claimed you sent me an email. However, it's not anywhere in my email server log and you can't reproduce it, either. Therefore, the "miscommunication" (as you call it) is on your end.
You are asking me to "work with [you]", yet you only present me with either unreasonable terms or terms that require me to spend more money for a part that I should have recieved with the cluster you sent me.
Last time: You get your odometer back. I get $100 (out of my $110) back. Can you agree to these terms?

NO, I am not at fault here, I never said I had an odometer. As a matter of fact, I emailed you stating just the opposite(I wish AOL kept emails longer than 7 days so I could prove it to you). I have gone out of my way to locate you an odometer. I am a very busy man and I took valuable time for this matter and if you cant appreciate that then I am sorry.
I told you that I will pay $50 towards the odometer(you will not find another gauge cluster or odometer anywhere for less than $150.) You will have spent $150 for the cluster and odometer; I will have spent $50 and two days looking for the odometer to sell you the cluster. This is an easy solution to this dilemma, please dont make it harder than it needs to be.
