Many states have laws that require them to only sell a car that will atleast pass inspection or some states require that all used car dealers give a mandatory 30day 1000mi warranty. And last, -anyone- can bring an action. That in itself is a major deterrent to not do the deal.

That should bring your lights up to 100watts... if not, oh well.
